This agreement is between you and Gymyos for you to collaborate with us: bringing people and gyms to Gymyos, supporting them and earning commissions for it. You accept it when you enter the panel as a collaborator. The Gymyos Terms and Privacy Notice also still apply to you. If you don't agree, don't enter the panel and write to us.

1. An independent relationship

You collaborate on your own, as an independent person. You are not a Gymyos employee, you have no schedule or boss, you get no salary and there is no employment relationship. You earn only the commissions in this agreement. You are responsible for your own obligations to the authorities for what you earn. You may not sign or promise anything on behalf of Gymyos.

2. What you do

  • You handle the requests Gymyos assigns to you, for example a gym in your area that wants to sign up, and you mark in the panel when you've handled it. You can also open requests for gyms or people you know. Final approval belongs to Gymyos, and whoever opens a request cannot approve it.
  • You share your invite code. Whoever creates their account with it becomes your invitee, and you decide whether to support them. Only you can take them; if you take them and later let them go, they move to Gymyos support for good and you can't take them back.
  • You support the people and gyms in your portfolio: you answer their help chat and stay with them if they fall behind on a payment.
  • If you like, you take cases from the general «Asking for support» list, from people who have no collaborator.

Gymyos decides your area and how many accounts you can handle at once.

3. Your commissions

You earn for these items:

  • Bringing in a person: a percentage of the first payment of someone you brought. It's yours even if you don't support them, and it doesn't move if another collaborator handles them later.
  • Bringing in a gym: a percentage of the first rent of a gym you brought.
  • Supporting a person: a percentage of each online payment by a person in your portfolio.
  • Supporting a gym: a percentage of the rent a gym in your portfolio pays online.
  • Help case solved: a fixed amount for each case from the general list that you solve, in the currency of whoever asked for help. Gymyos sets how many cases from the same person are paid per month.

If you are the Liaison for a gym in the GymyosPass network, you also earn on the Gymyos share from that gym. Commissions for collecting cash only apply to payments you recorded before online payment existed. Gymyos sets your percentages and amounts, and you see them in the panel. You can propose others; Gymyos decides. A change applies only to future payments: the percentage of each payment stays fixed from the moment it comes in. If Gymyos hasn't set your percentage for an item yet, that payment generates no commission until it's fixed.

4. When a commission is yours

  • Every payment has a period to cancel it with a refund, which depends on the country. While it runs, your commission is on hold. If the payment is cancelled or refunded, no commission is generated.
  • The commission for supporting a person also waits until the period they paid for ends, and only counts what they paid while already in your portfolio. If they leave your portfolio before that period ends (because you let them go, they move to another collaborator or you don't answer their case in time), you lose that period's commission.
  • Payment for a help case is earned when the person says it was solved, or when the case closes on its own because they stopped replying.
  • If a payment is corrected or has a chargeback after your commission was already paid, Gymyos may adjust the difference in your next payments.
  • You earn no commission on your own account or your relatives' accounts: you must declare them in the panel and they never enter your portfolio.
  • Proposing someone else as a collaborator earns you no commission, neither when they sign up nor on what they sell later.

5. You no longer collect cash

People and gyms pay online directly to Gymyos. Don't accept cash or transfers in your name for subscriptions or rent. If you hold cash from earlier collections, you must hand it over to Gymyos within the days shown in the panel; Gymyos confirms each delivery and warns you if you go over the cash-in-hand limit or the deadline.

6. How we pay you

We pay what you're owed by transfer to the CLABE you registered, in the first days of each month. You can ask in the panel for an advance, for example if you're going to stop collaborating; Gymyos decides whether to advance it. Each currency is paid separately. In «My money» you see each commission, which payment it comes from and whether it has been paid to you.

7. Your data

To register you we ask for your RFC, your CLABE and an official ID (photo or PDF). They're stored encrypted and only the Gymyos administrator sees your ID. Keep them up to date: if your CLABE is wrong, we can't pay you. We keep a record of every action Gymyos takes on your collaborator account, with who did it and why.

8. Response time and inactivity

Answer the help cases in your portfolio within the time Gymyos sets, which you see in the panel. Otherwise the case moves to the general list. Gymyos measures how long you take to handle what's assigned to you and compares collaborators with each other. If you go some time without activity, Gymyos gets a notice and may move your portfolio to another collaborator. Nothing is moved automatically: a person at Gymyos decides.

9. Confidentiality

You see the data of the people and gyms in your portfolio only to support them. You don't see their body, measurements or health, and you must not ask for them.

  • Don't copy, keep, sell or share their data outside Gymyos.
  • Don't contact them to offer other products or services.
  • When you stop collaborating, delete any of their data you have outside Gymyos.

This obligation continues after the agreement ends.

10. Use of the brand

You can say you collaborate with Gymyos and use the name and materials we give you, only to invite people and gyms. Don't create accounts, pages or ads that look like official Gymyos ones, don't promise prices, discounts or features the app doesn't have, and don't spam.

11. Telegram notices

You can get the panel notices on Telegram. It's optional. To turn it on you confirm the number is yours by sharing it with the Gymyos bot. Notices pause on their own if you change phones or stop being a collaborator, and you can disconnect whenever you like.

12. Suspension

Gymyos may suspend you if you break this agreement, if there are serious complaints from the people you support, or if there are doubts about money. While suspended you earn no new commissions. In a serious case Gymyos may cut you off immediately; your commissions are held while you owe Gymyos money. Every suspension is recorded with its reason.

13. Leaving

You can stop collaborating whenever you want by writing to [email protected], and Gymyos may end this agreement. When you leave:

  • Your portfolio moves to another collaborator chosen by Gymyos. Your invitees move to Gymyos support, unless you ask to pass them to another collaborator and they accept.
  • You must hand over everything pending, including any cash, before your exit is closed.
  • We pay you what you're owed.
  • You can't be a Gymyos creator while you are a collaborator.

14. Changes to this agreement

If we change this agreement we'll publish the new version with its date and ask you to accept it when you enter the panel.

15. Governing law

This agreement is governed by the laws of Mexico.

16. Contact
